Terms and conditions
The aim of these Terms and Conditions is to describe the procedures which apply to the use of the online reservation service for Enotourism activities, provided by the Portugal by Wine platform.
In addition to the terms described herein, the activity reservation process is also regulated by the individual terms of each service provider, in particular the booking procedures, availability, or the cancellation policy. These terms are simultaneously made available with the description of each activity.
By registering on the platform, you acknowledge to have read, understood and agreed to these Terms and Conditions. By confirming the reservation (or reservation request), you also accept all the conditions of the service, including the cancellation policy, set out by the service provider.
We reserve the right to amend and/or update these Terms and Conditions at any time without notice, therefore you should review the conditions on a regular basis and before making reservations on the platform.
1. The Service Provided by Portugal by Wine
The Portugal by Wine platform operates on the internet as a website to advertise and book leisure activities, within the Portuguese wine and gastronomy tourism sector. The activities are rendered by partners (service providers), such as tour operators, wineries and vineyard estates, with an offer located exclusively inside the Portuguese territory. Our service is free; we do not charge you any additional fee besides the actual cost of the reservation.
By making a reservation on the platform, you enter into a direct contractual relationship with the service provider. Portugal by Wine acts solely as an intermediary in this process. Thus, not having any contractual liability whatsoever nor a responsibility regarding the agreement between both parties.
2. User Registration
In order to make bookings, request tailor-made experiences, or contact partners through the message centre, you will have to sign up on the platform, where your personal data will be required. You will be held accountable for ensuring that this data is both accurate and up-to-date, as well as for any activity that occurs in your account. During registration, you must accept the conditions herein described, by acknowledging you have read and understood them. If you wish, you may cancel your account, at your sole discretion, at any time, without any kind of penalty.
3. Content Liability
3.1 The information on the partners and the services they provide is their sole responsibility, in particular the informative texts, the description of the activities, the photographs, the prices, or the translations into the other languages on the platform.
3.2 The service provider undertakes to post reliable, accurate and up-to-date information at all times, and may be held liable for customer claims, based on alleged inaccuracies.
3.3 Portugal by Wine undertakes to verify and validate the information submitted by the service provider on the platform; however, it is not responsible for its accuracy or authenticity.
3.4 The information on the platform contains material and trademarks that are protected by copyright and trademark law, so you may not alter, publish, transmit, participate in the transfer or sale, create derivative works of, or otherwise exploit the content, neither fully nor in part.
4. Booking Process
There are two booking methods on the Portugal by Wine platform:
4.1 Reservations Subject to Confirmation
The reservation is subject to confirmation. The service provider has 48 hours to validate it (considering the service providers' business days, the confirmation period may be longer). After making the reservation request, you will receive an email with the data of the pending reservation. If the request is accepted, the contract with the service provider becomes valid and the reservation is confirmed by a confirmation email with all the data of the service you have purchased. The same email shall be used as a voucher and should be printed and presented when redeeming the service. If the reservation is not validated by the service provider, you will receive an email informing you that your reservation was not confirmed.
4.2 Reservations with Instant Confirmation
This type of reservation is automatically accepted and confirmed by the system. Automatic reservations are based on a feature managed by the service provider, who chooses to display the availability of the activities in the system beforehand. With this type of reservation, you will receive a confirmation email with all the data of the service you have purchased immediately after making the reservation. This email shall also serve as a voucher; therefore, it should be printed and presented to the service provider when redeeming the service.
4.3 Special Booking Conditions
In some experiences, there may be special conditions for groups, namely discounts. This information is set out in the booking process. There may also be special conditions for children, depending on the age, in particular the amount to pay for the experience. You should review the description of the activity to confirm its conditions.
4.4 Offering an Experience
The user will have the opportunity to purchase an activity to offer to third parties. When booking through this method, you will select the number of people to enjoy the experience, but not the date. After validation and payment, a voucher will be issued and sent to the address you provide (your own or that of a third-party). The validity for scheduling the voucher is 6 (six) months, which must be done directly with Portugal by Wine, in order to book the date for the enjoyment of the respective experience.
4.4.1 Portugal
by Wine reserves the right to change the gift voucher activity, for one of
similar profile and value, whenever:
- The
partner doesn't have availability for the experience, during the valid period
of the gift voucher;
- The experience is no longer available
by the partner's initiative, during the gift-voucher validity period.
4.4.2 The cancellation of the gift voucher can be made by the purchaser during the validity period of the voucher, that is, 6 (six) months after the purchase. In these cases, the purchaser will receive a refund of the amount paid, less the cancellation fees applied by Portugal by Wine, of 5% of the amount paid. As with all cancellations, the refund will be made by the same method used for payment. Under no circumstances may it be the person to whom the voucher was offered, to proceed with the cancellation.
4.5 Reservations Deadline
The period of time necessary to make a request/booking is 48h.
It is not possible to make any reservation more than one (1) year in advance.
5. Prices

5.1 Price Types
There are two types of prices for Portugal by Wine experiences:
- Price per person;
- Price per pack.
For experiences with price per person, after selecting the desired number of people, the sum of the value will be shown, relative to the total number of people added.
For experiences with price per pack, the values shown will be relative to the total number of people that the respective pack includes.
These conditions are specified in the booking conditions for each activity.
5.2 Fixed and Variable Prices
Some of the experiences may vary in price depending on the day of the week and the time of year.
After selecting the desired day in the calendar on the experience page, the final price for the chosen date will be displayed.
There are also experiences that require a quotation request to be made to the partner, stating the date, the number of people and the preferred language. In this case, the partner will respond to the request, via email or message centre, within a maximum period of 48 hours, where they will provide information about availability and quotation, according to the data submitted in the request.
6. Cancellation Policy
All cancellations, either at your own request or at the request of the service provider, must be made through the platform.
6.1 The cancellation policy will vary according to each service provider and/or activity. Hence, the service provider will apply its own cancellation policy, complying with all the requirements, deadlines and penalties that characterise it. The cancellation policy is set out in the informative content of each activity.
6.2 It is the responsibility of Portugal by Wine to manage the refund process between the service providers and the client. Funds will be returned to your PayPal account, credit card or other means, depending on the payment method originally used. The only exception is when the reservation was paid with the ATM reference.
6.3 If the cancellation is made by the service provider, you will be fully refunded for the amount paid, unless you and the service provider agree otherwise.
6.4 If the cancellation, upon the initiative of the user, and complies with all the requirements set out in the cancellation policy, you will be refunded the total amount of the reservation minus a reimbursement fee of 5% (processing costs).
6.5 In case of late cancellations where you have not fully complied with the cancellation policy, the amount paid for the experience may be partially or fully withheld. This information is set out in the activity cancellation policy. When the amount you have paid is partially withheld, Portugal by Wine will charge an additional fee of 5% (of the total amount of the reservation) in order to cover the processing costs for the reimbursement of funds.
6.6 If you do not fully comply with the cancellation policy, or do not appear at the scheduled place and time to redeem the service, you will not be reimbursed.
6.7 In the case of any change in the specifications of the activity (time, venue, service, etc.), you will be informed by the service provider via email or through the platform, within a maximum of two business days, before the date of the activity.
6.8 The clients refund will be made in 30 (thirty) days maximum, except in situations where the partner delays the refund to Portugal by Wine, in this situation, the reimbursement to the customer is conditioned to the return of the funds by the partner.
6.9 The Portugal by Wine is not responsible, if a partner does not make the repayment within the time limit or in full, according to cancellation policy, being the responsibility of the client the action with the partner, in case of non-agreement, in order to regularize the situation.
7. Tailor-Made
Portugal by Wine allows the user to make a request for a personalised experience on the "Tailor-made" page, present on the platform.
To make a request for a customised programme, the user must submit the form, which requires the filling in of the following fields: phone contact, country, Wine Regions that are desired to be visited, the number of people, the desired duration, the preferred date for the activity, or date range, the total budget and the description of the type of experience wanted.
7.1 Types of Tailor-Made Activities
Tailor-made programmes are designed and organised by Portugal by Wine, based on the preferences of the customer. The operability of the activities will be carried out by Portugal by Wine's network of selected partners.
Several services and activities can be added to a tailor-made programme, with different durations, according to the customer's expectations. From wine tours, winery experiences, river activities, accommodation programs, transfer services, corporate events, among others. Depending on the complexity of the programme requested, a payment in the form of a deposit may be required for the design of the activity.
8. Direct Messages and Online Chat
In order to allow the direct exchange of messages with the service providers, the platform provides a message centre feature, where the user can exchange information regarding the performance of the services directly with the service provider. Direct messages cannot be used to make requests, confirm reservations, make cancellations, nor to send messages of personal nature irrelevant to the provision of the service.

9. Rating system
After taking part in an activity, you will be invited via e-mail (you can also do so on your own discretion directely on the experience page) to comment on your experience and give a score to certain criteria. The purpose of the rating is to create feedback on the service provider's profile (and its activities) in order to assess it, regarding performance, reliability and authenticity. Portugal by Wine reserves the right to verify, validate and publish these reviews and ratings, as well as to remove them, if they include obscenities or false accusations.
10. Payment methods
The Portugal by Wine uses payment-processing systems that guarantee total security, speed and simplicity so that customers can make their reservations online.
For payments by credit card, Visa or Mastercard, the user has two options. Through the Stripe platform (Stripe, Inc.), integrated directly into the checkout page, or through the Paypal platform, which offers payment by credit card.
Bookings can also be paid directly with your PayPal account (PayPal Holdings, Inc), transferring the funds to Portugal by Wine, without give the credit card data.
Three payment methods are made available to the users:
a) By credit card (Visa, Master Card) via Stripe;
b) Via Paypal account;
c) With credit card (Visa, Master Card) via Paypal account;
These payment options are selected by the customer in the checkout process.
Taking into account the specifications of the different booking methods available in the platform, the payment can be processed in two different ways, as follows:
10.1 Automatic Reservations - Immediate Payment
For bookings that have automatic validation, payment processing will be immediate, shortly after the reservation process is complete.
10.2 Reservations Subject to Confirmation - Deferred Payment
For bookings that need to be validated by the service provider, the system will issue a pre-authorization of payment, in the total amount of the reservation. In these cases, the payment will only be processed when the service provider validates the pending reservation. If the reservation request is not validated, no amount will be charged to the customer. The funds will be released from 1 to 2 business days.
The payment will be available in 25 currencies, and whenever it is made in a currency other than Euro, it will be converted at the current exchange rate (PayPal and credit cards).
The Portugal by Wine cannot be held responsible for unfulfilled payments due to incorrect or incomplete information of the customer.
If you cancel the payment of the credit card before using the service, if you do not make the payment through an ATM reference number within the time limit, or if the payment is not made for any other reason, the reservation will be cancelled (gift-vouchers).
After the payment is processed, you will be emailed an invoice for the amount paid.
11. Personal Data Protection Policy
By agreeing to these Terms and Conditions, the user allows Portugal by Wine to compile, process and store their personal data (set out in detail in the Privacy Policy). Portugal by Wine commits to ensure adequate security procedures to prevent unauthorized access to the confidential information of its users. Portugal by Wine also commits to process and access any personal information of its customers in accordance with the applicable legal terms and complying with the rules of the Personal Data Protection Act (Regulation EU 2016/679 of the European Parliament and of the Council of 27 April 2016).
11.1 Portugal by Wine uses the Secure Socket Layer (SSL) protocol to encrypt and protect customers' personal information. Your payment information will never be stored on the Portugal by Wine platform. However, it may be stored on the PayPal platform if you choose to allow it, in order to facilitate future payments.
11.2 Portugal by Wine has the right to cancel any reservation if there is a reasonable suspicion of improper use of the user's card or identity.
11.3 Portugal by Wine acknowledges its responsibility for the security of the customers' personal data processed and stored within the scope of this service. Portugal by Wine is not responsible for the improper use or disclosure of customer information by the service providers.
12. Payment Fees
10.1 Transaction fees for online payments will be borne by Portugal by Wine.
10.2 In case of cancellation by the costumer, a fee of 5% will be debited in order to cover processing costs.
10.3 In cases of cancellation at request of the service provider, processing costs will not be charged.
13. Best Price Guarantee
Portugal by Wine service providers undertake to practice the same prices for their services on our platform, regarding the rates they charge directly to customers or through channels belonging to third parties.
14. Travel Insurance
The activities on the platform do not include individual travel insurance. Before taking part in the experiences, we recommend that you purchase travel insurance, which includes medical expenses, travel cancellations and other related losses.
15. Customer Complaints
Claims, complaints or requests regarding the provision of services should be sent directly to the service providers. Portugal by Wine is exempt from such responsibility. However, Portugal by Wine may, at any time and in its sole discretion, offer support to users, act as an intermediary in resolving disputes or suggest equivalent alternative services.
In the case of disputes, and under Law 144/2015 of September 8, we hereby inform you that you may appeal to the following Alternative Dispute Resolution Bodies:

c) Or any of the entities listed by the Consumer Protection Office at www.consumidor.pt, whose consultation we strongly advise.
16. Limitation of Portugal by Wine's Liability
16.1 Portugal by Wine is not accountable nor does it guarantee any type of compensation for any temporary or permanent interruptions of the platform operation.
16.2 Portugal by Wine shall be liable for any loss of confidential information stored in its servers.
16.3 Portugal by Wine shall be liable for losses intentionally caused by any of its employees or legal representatives.
These Terms and Conditions, the provision of the services by the service providers and all the content disclosed on the platform, shall be governed by the Portuguese law; any legal dispute falls under the jurisdiction of the District of Aveiro, Portugal.
